Don't rely on that baseball field. My understanding is that they still haven't been able to get the properties on canal St that they need. I also heard the city council won't have the balls to take it by eminent domain. So the field of dreams may just be that, a dream.

Paul : you need to understand the criminal justice system in MA better before you start commenting. A misdemeanor means that the CRIMINAL OFFENSE may result in jail time in a house of correction (HOC). A felony means that the CRIMINAL OFFENSE may result in jail time in state prison. Less than an ounce is a civil offense. Which means that you are not convicted beyond a reasonable doubt, but just based on the preponderance of evidence. Just like when you get a civil motor vehicle infraction. There's also no need to yell.

SECTION 7.1B NUISANCE PROHIBITED - PUBLIC CONSUMPTION OF MARIJUANA
For the purpose of preserving the right to peaceful, quiet and
orderly enjoyment of public places to inhabitants of the city,
the following activities are declared to create a public nuisance
and are prohibited at all times:
1. The use or consumption, either by smoking or ingestion,
of marijuana on any publicly owned property, including but
not limited to streets, sidewalks, parks, playgrounds and
school grounds;
2. The use or consumption, either by smoking or ingestion,
of marijuana on any privately owned property to which the
public has a right of access without consent of the owner or
person in control thereof.
Violation of any provision of this ordinance may be punished by
arrest and a fine of not more than $100.00 for each offense. -

Massachusetts General laws on any privately owned property

Possessing and consuming are two different things. Possessing less than an ounce of marijuana is a civil fine. But consuming it in public is a different story. The same as alcohol. You can posses alcohol in public but you cannot consume it in public in Malden.
I will direct you to the city ordinances chapter 7 sections 7.1 and 7.1B

Someone walking down the street with a beer isn't always illegal. It has to be open. And even then it's up to each city/town to have an ordinance about it. There is no MGL. I believe Malden has put marijuana into its drinking in public ordinances and thus it is arrestable.

Maybe they should call http://www.angieslist.com/companylist/us/ma/medford/g-and-b-handyman-and-maintenance-services-reviews-7571374.htm and ask if they know them since it looks like that is the sweatshirt that is being worn by the other person.
