Malden's New Medical Marijuana Regulations: What Do You Think?

The state's new medical marijuana law has city councils and planning boards all over the commonwealth preparing. What do you think of Malden's approach?

The Malden City Council approved new regulations for medical marijuana dispensaries Tuesday night, zoning any future facilities within the city's industrial areas and barring their operation within 300 feet of residential dwellings, schools, public parks and playgrounds.

The new regulations will also require dispensaries to apply and pay for an annual license with the city. 

“This paper is very carefully crafted by our (city) solicitor (Kathryn Fallon), our health director Chris Webb, and (city planner) Michelle Romero,” Councillor Jim Nestor said.

“It should be clear to everybody we do not want these centers in Malden....We felt if we just (banned) them outright, we'd lose a legal challenge to that. This allows us to have complete control.”

The city's industrial 1 and 2 zoning districts stretch for most of Eastern Ave/Route 60, and along parts of the Malden River.

Massachusetts became the 18th state to legalize medicinal marijuana this year after voters overwhelmingly approved the measure last November. 

The ordinance:

"Medical Marijuana Treatment Center: An entity, however, organized, as defined by Massachusetts law only, registered under this law licensed by the state Department of Public Health or other applicable state entity, that routinely acquires, cultivates, possesses, processes (including development of related products such as food, tinctures, aerosols, oils or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana products containing marijuana, related supplies or educational material to qualifying patients or their personal caregivers.

No Medical Marijuana Treatment Center shall be located with 300 feet of the property line of a property used for a residential dwelling, public or non-public school or public park or playground.

A special permit issued to a Medical Marijuana Treatment Facility is non-transferable and nonassignable.

A Medical Marijuana Treatment Center shall not be allowed as an accessory use to any other use."

David, the proposal is based on pre-existing zoning in the city. It just so happens that the industrial corridor extends from Route 60 and down the Malden River area (toward Everett). They felt this would minimize impact to residential areas and other sensitive uses.

The vote was not close at all, nearly 2-to-1 in favor - 63 to 37%.

I agree the councillor should be clearer about his . THE residents of Malden are in favor and more importantly he should be advocating for those sick residents off Malden who need this medication. The harsh generalization that those who need medical marijuana are undesirable folks who are going to ruin the downtown is ignorant, and immoral is an impediment to community development and business.

There are tests, and officers trained to identify those under the influence of drugs. Sobriety tests that are physical its one test. Walk the straight line, follow my finger, count backwards, etc. and saliva tests exist that Will show marijuana use as recent as 2 hours ago.. Plenty of people her pulled over drunk and charged without taking a breathalyzer.

According to "Intervention America" there are two methadone clinics in Malden not including the unlicensed one that opened on pearl street. Maybe the information is outdated and they are closed, but I remember talking to a business tenant on pleasant street near main street who had to deal with the methadone clinic above the business, and didn't find out about it until after opening. Again, maybe they are closed, but it couldn't have been that long ago, so don't act like they've never been here.

Why aren't the drug stores handling distrubution of marijuana. If it is supposed to be medicimal why the POt Shop. See your just opening the door for more to come. You'll see. To Mass Vocals....#1) If you don't like the prospect of taking a drug screen for pre-employment, then by all means, DON'T apply for the job! It's just that simple. Then no one's feelings are hurt. #2) I don't know where you get your information, but you couldn't be more wrong! There is always some new 'adulterant' being sold out there that claims to defeat THC detection. Funny thing about drug testing at Quest....we tend to retest those same specimens. It's called a 'confirmation', which includes, but is NOT limited to detecting adulterants, but also testing for other techniques used for the purpose of masking THC, like ferosemide, Vitamin B, etc. SO, in a nutshell, Mr. Mass, if we find those known maskers, it's pretty certain that person is trying to mask THC. Now, don't you feel foolish in making those uneducated, cut, copy & pasted remarks? I know I would! We at Quest aren't law enforcement, we just do the analyticals that we are asked to. You've been served, sir!

Dave, why do you think my advocacy of medically marijuana for ill patients suggests i I need my weed? Why are you advocating morphine over marijuana for pain management? And your wrong on the account of starting I suggested medical marijuana cured anything. AND what list are you referring to? I could give you lists published by accredited sources proving there's legitimate medical use for marijuana...after all, if such documentation did not exist, do you really think the state of ma would allow it?...I hope not because I don't want to go off into conspiracy land with you.

not so , i have product that nullifies the test m beside this the reason testing is base on lies frankly , the fink government / insurance have no evidence what so ever as to marijuana / vs work . performance testing is not drug testing anyone who is ask as you say to be tested and says no like you say can not work unless your in a constitutional state like VT there the law finds you the tester and employer criminals for your violation now that just one state no prerequisite testing allow , here in Massachusetts there is no law there for you asked where are you testing now > i will come apply for job and bring a law suit on the employer sounds great to me i make my living now this way and we need case in mass so please tell me where they sending you next I like to put you out of a job massvocals

Arbour Couseling in Malden Sqaure has Dr.'s that prescribe suboxone. I do not know of a methadone clinic in Malden.
