Actual Citizens' Petition for Fees Change to PAYT

The following is the revised Citizens' Petition approved by the Legal Dept. of City Hall after meeting with Mayor Christenson who strongly objected to our original petition.

CITY OF MALDEN
AN INITIATIVE PETITION FOR A SOLID WASTE MANAGEMENT ORDINANCE

AN ORDINANCE THAT ELIMINATES APPROVED FEES FOR RESIDENTIALWASTE.

We, the undersigned qualified voters of the City, petition your honorable body for passage of the following ordinance, or, in the alternative, submission of the same to a vote, as provided in Section 6 of Chapter 114 of the Acts of 2011:

“Be it ordained that the Revised Ordinances of 1991, as amended, be and the same are hereby further amended as follows:
-by striking out Section 9.28C paragraph 1 and inserting in place thereof the following:

1. FEES:
Commercial Waste/Residential Waste –Buildings of 6 or MORE units:
Fees for collection of residential waste from buildings of 6 units or more and for collection of commercial waste shall be as follows:

13 gallon trash bag $2.00 ea.
30 gallon trash bag $4.00ea.

Payment of the appropriate fee shall be indicated by affixing to each bag a sticker provided by the City. Stickers shall be available on the City’s website and at the office of the City Clerk.

Residential Waste – Buildings of LESS than 6 units:
Fees for the collection of residential waste from buildings of less than 6 units shall be as follows:
40 gallon (or less) lidded trash receptacle FREE
13 gallon trash bag $2.00
30 gallon trash bag $4.00
Bulk Item – 35lbs or less FREE
Bulk Item – in excess of 35lbs $10.00
White goods $20.00

The City shall provide each residential unit in a building containing fewer than 6 units with one Trash label, free of charge to be attached to a resident provided barrel with a lid. Any unit generating trash in excess of 40 gallons in a week shall purchase stickers for resident-provided trash bags from the City in accordance with the schedule set forth above. Stickers shall be available for purchase on the City’s website and at the office of the City Clerk. Labels for Recycling shall be available from the DPW.
