A prisoner from the Billerica House of Corrections assigned to work at Forest Dale Cemetery Tuesday afternoon walked away from the scene, but was apprehended by police about an hour-and-a-half later on Cedar St.
A spokesman with the Middlesex County Sheriff's office said state privacy laws barred him from naming the prisoner, who was convicted of a non-violent offense.
The man will be publicly identified when his formal charges are made public at the Lowell District Court.
“Anyone at the Billerica House of Corrections (face sentences of) 2.5 years or less – your murderers and things like that aren't at the house of correction," department spokesman Michael Hartigan said. “The majority are in for drug-related offenses."
