Malden's New Medical Marijuana Regulations: What Do You Think?

The state's new medical marijuana law has city councils and planning boards all over the commonwealth preparing. What do you think of Malden's approach?

 

The Malden City Council approved new regulations for medical marijuana dispensaries Tuesday night, zoning any future facilities within the city's industrial areas and barring their operation within 300 feet of residential dwellings, schools, public parks and playgrounds.

The new regulations will also require dispensaries to apply and pay for an annual license with the city. 

“This paper is very carefully crafted by our (city) solicitor (Kathryn Fallon), our health director Chris Webb, and (city planner) Michelle Romero,” Councillor Jim Nestor said.

“It should be clear to everybody we do not want these centers in Malden....We felt if we just (banned) them outright, we'd lose a legal challenge to that. This allows us to have complete control.”

The city's industrial 1 and 2 zoning districts stretch for most of Eastern Ave/Route 60, and along parts of the Malden River.

Massachusetts became the 18th state to legalize medicinal marijuana this year after voters overwhelmingly approved the measure last November. 


The ordinance:

"Medical Marijuana Treatment Center: An entity, however, organized, as defined by Massachusetts law only, registered under this law licensed by the state Department of Public Health or other applicable state entity, that routinely acquires, cultivates, possesses, processes (including development of related products such as food, tinctures, aerosols, oils or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana products containing marijuana, related supplies or educational material to qualifying patients or their personal caregivers.

No Medical Marijuana Treatment Center shall be located with 300 feet of the property line of a property used for a residential dwelling, public or non-public school or public park or playground.

A special permit issued to a Medical Marijuana Treatment Facility is non-transferable and nonassignable.

A Medical Marijuana Treatment Center shall not be allowed as an accessory use to any other use."

As long as big pharm can make money on it it's good, like cigarettes and booze,,, as long as major corporations can make money on it.

My wife doctor authorized it for pain management for her hip replacement, but she has to take a urine test to make sure she is not smoking cannabis,,, Funny huh?

According to "Intervention America" there are two methadone clinics in Malden not including the unlicensed one that opened on pearl street. Maybe the information is outdated and they are closed, but I remember talking to a business tenant on pleasant street near main street who had to deal with the methadone clinic above the business, and didn't find out about it until after opening. Again, maybe they are closed, but it couldn't have been that long ago, so don't act like they've never been here.

Again, Mr. Mokal....medical marajuana has a purpose. Maybe someday, and I hope you won't need it, but you may develop a medical condition that canibus could help with pain. It is just a ridiculous notion that a lot of thread contributors to this site still think people walk around after smoking marijuana and commit violence crimes, let alone any. If any of you actually smoked the stuff, then you would know that all you want to do is chill out! My mother died from lung cancer. For the short time she was sick, she was in a great deal of pain. Until you walk in somebody's shoes, don't judge!

David, the proposal is based on pre-existing zoning in the city. It just so happens that the industrial corridor extends from Route 60 and down the Malden River area (toward Everett). They felt this would minimize impact to residential areas and other sensitive uses.

I fully support medical marijuana, and feel as though dispensaries providing medicine should not be discriminated against. Looking forward, if these dispensaries are not put in easily accessible locations, this would provide a hardship under the MA law, patients would be allowed to grow in their homes, increasing the risk of from over loaded outlets, increase need for inspectional services, and overall impediment for access to prescribed medicine.

Mr. Mokal, to answer your question, working in a medical diagnostic lab, you would have to be forced to submit a urine specimen to check for it. There is no instantaneous testing that could be performed roadside by law enforcement. Blood testing is not considered reliable, as THC will only remain in the bloodstream for a few hours at best. Urine testing is far more accurate and reliable. We test, on average, over 700 urines specimens a day for drug testing. In order to be forced to submit to urine screen, you would have to be an 'active participant' in the court system. So, NO, there is no roadside screening that could be performed.

There are tests, and officers trained to identify those under the influence of drugs. Sobriety tests that are physical its one test. Walk the straight line, follow my finger, count backwards, etc. and saliva tests exist that Will show marijuana use as recent as 2 hours ago.. Plenty of people her pulled over drunk and charged without taking a breathalyzer.

The majority of voters may have approved it on the ballot, but the decision was close and there was really no organized opposition to present the true picture of medical marijuana. I work in healthcare and smoking is just about the most primitive drug delivery system you could choose. You get a quick hit but there are plenty of pharmaceutical pain reduction options that are better and safer. We don't want you to smoke tobacco - but weed is OK? You can now prescribe this for everything from glaucoma to cancer. It's misplaced sympathy that will now lead to insanity and opens the door for all the recreational users. It's unfortunate that no public information campaign was mounted to get the facts out before the election about medical marijuana like the death with dignity campaign was able to do so that foul proposal was defeated. I am liberal and sympathetic to anyone in need but folks, legal distribution of marijuana is just ridiculous. And how many dispensaries do we need? Does every city have to have one or more? Not a lot of though went into this ballot question as most are poorly drafted. I am glad that Councillor Nestor and his group were able to at least put some conditions on the siting of these dispensaries but Malden and Massachusetts basically just opened the barn door and you can't shut it now.

At least one city per country will have a dispensary. Glaucoma to cancer it's a wide spectrum...especially when it is clinically proven to lower eye pressure and help cancer patients. As far as smoking it, you can vaporize it, eat it, take a pill or have an oil tincture...

Hey CALB....you claim to work in healthcare, huh? Do you know the difference between marijuana and cigarettes? You know how big tobacco gets cigarette papers to burn slower? They add formaldehyde....you know....embalming fluid? Formaldehyde, is very alkaline, which also contributes to the slow burning of the cigarrette. Acetone is used for the aroma portion, as when the cigarette burns, the acetone contributes to the aroma. Want me to go on? Marijuana, in it's original, cultivated form, has NONE of these ingredients! Congrats to you for being another 'informed' thread contributor....please!

Drunk people are irresponsible and often violent. Alcohol is found in the system of 40% of violent criminals. About 25,692 die each year directly from alcohol, and another 15,990 from liver disease induced by alcohol.

I assume you drink alcohol which is why your feathers are ruffled by my preference for a dispensary over a liquor store. You are free to enjoy your drug of choice, but know that it is an incredibly harmful one. :)

Man what a clown show this forum has become. I love ignorance and misinformed people. The largest products these dispensaries tend to sell are teas, tinctures, foods ,and oils. Many often sell snacks that are infused etc.This does not mean they do not offer smoking marijauna but it is just a part of it. Seed bearing plants are not drugs you stupid fools. Drugs are made in labratories and abused more than anything these days. Alcohol is readily available everywhere and causes more problems and deaths than THC ever will....Malden is a complete mess yes but this won't make it any worse believe me...Malden is full of heroin addicts and drunks and welfare cases sucking off the governments tit! For the record I am 100% drug free and marijauna free and have a social beer or drink only once in a while...Wake up Maldonians you close minded fools..What they should open in Malden is a clown college. David Mokal could be the new Dean...

@ Mike..Not me Mike..My feathers dont get ruffled at all. I could care less about what anyone does. I want to see the Distributors in the middle of Malden Square. Dont hide it.I love pissin contests Mike. What I want to see is the cronnie Doctors handing out scripts like candy and with mixed with other drugs lay frothing at the mouth and spewing all over the city hall steps. This will happen. They will still be able to buy illegal drugs and supplement them with their scripts. Ever go to the local big chain prescription store here in Malden. I see people in there waiting to get their scripts and can hardly stand up. Just last week the kid beside me had a huge foot long bogger hanging out of his nose waiting for his med prescription. I laugh at this stuff. Hey ya want to smoke your weed be my guest ...knock yourself out.. I find this FUN!!!

Malden's voters approved the referendum in November by a large margin: the vote was 11,666 yays versus 7,437 nays (61-39 percent). That's a pretty significant difference.

Councilor Nestor should clarify who he means when he says, "It should be clear to everybody we do not want these centers in Malden ..."

The voters apparently DO want them.

I agree the councillor should be clearer about his . THE residents of Malden are in favor and more importantly he should be advocating for those sick residents off Malden who need this medication. The harsh generalization that those who need medical marijuana are undesirable folks who are going to ruin the downtown is ignorant, and immoral is an impediment to community development and business.

Form the research I have done, the average age of a MMJ patient is men between 24 and 48,,, I'm 52,,,,

@ Paul Surette 3 deaths in my family from cancer and I also suffered from an injury where I had to learn how to walk again. You bet Ive walked in someones shoes. Back in the 60's my Brother was in an explosion and laid on a rubber matress for 2 years. Dont talk to me about walkin in someone's shoes cause Ive been there done that. No pain pills did it my way with no help. Be carefull what tree you bark up.

To Mass Vocals....#1) If you don't like the prospect of taking a drug screen for pre-employment, then by all means, DON'T apply for the job! It's just that simple. Then no one's feelings are hurt. #2) I don't know where you get your information, but you couldn't be more wrong! There is always some new 'adulterant' being sold out there that claims to defeat THC detection. Funny thing about drug testing at Quest....we tend to retest those same specimens. It's called a 'confirmation', which includes, but is NOT limited to detecting adulterants, but also testing for other techniques used for the purpose of masking THC, like ferosemide, Vitamin B, etc. SO, in a nutshell, Mr. Mass, if we find those known maskers, it's pretty certain that person is trying to mask THC. Now, don't you feel foolish in making those uneducated, cut, copy & pasted remarks? I know I would! We at Quest aren't law enforcement, we just do the analyticals that we are asked to. You've been served, sir!

not so , i have product that nullifies the test m beside this the reason testing is base on lies frankly , the fink government / insurance have no evidence what so ever as to marijuana / vs work . performance testing is not drug testing anyone who is ask as you say to be tested and says no like you say can not work unless your in a constitutional state like VT there the law finds you the tester and employer criminals for your violation now that just one state no prerequisite testing allow , here in Massachusetts there is no law there for you asked where are you testing now > i will come apply for job and bring a law suit on the employer sounds great to me i make my living now this way and we need case in mass so please tell me where they sending you next I like to put you out of a job massvocals
